What Is Aggravated Assault In Virginia?

Simply put, an attack is the threat of physical harm and the ability to carry out the threat. It means someone was afraid of getting hurt.

Aggravated assault is when someone wants more than to scare the victim. For example, intent to kill can be considered grievous bodily harm. Serious bodily injury is punishable as a felony or misdemeanor.

Therefore, while the difference between aggravated assault and aggravated assault may lie in intent and consequences, the terms can actually be used to reinforce each other. The perpetrator of grievous bodily harm can be charged with grievous bodily harm, while the crime he commits can be called a felony.

"Aggravated/felony bodily harm is the unlawful assault of another person in which the perpetrator uses or displays a weapon in a threatening manner, or the victim suffers obvious serious or grievous bodily harm, including obvious broken bones, loss of teeth, possible internal injuries, serious wounds, or loss of consciousness."
